Terms of Use

DRAFT, not yet reviewed by a lawyer. Written to describe what the app actually does today. Anything involving subscriptions is worth thirty minutes of a lawyer's time before launch, and this document must be revisited when advertising is added, because that changes what is true.

What you may do with FLSH, what we promise, and what happens when you pay for something.

THE AGREEMENT

These terms are between you and [LEGAL NAME AND ADDRESS OF THE SELLER], the maker of FLSH. Using the app means you accept them.

This bracket has to be filled in before launch, and it is not a formality. A contract that does not name one of its parties names the person behind it, and on an App Store Connect account held by an individual that is a named human being with a private address. If a company is going to be the seller, it has to exist before the app is published, because the seller cannot be changed afterwards without transferring the app. Every limitation of liability below protects whoever is named here. If you do not, do not use the app, and if you have paid for something, Apple's refund process is described below.

WHO CAN USE IT

You must be at least 13 to use FLSH, and at least 16 if you are in a country whose law sets that as the age at which somebody can agree to this on their own. FLSH is not built for children and is not offered to them. If you are under that age, ask whoever is responsible for you to agree on your behalf, or do not use it.

WHAT YOU GET

A personal, non-transferable licence to use FLSH on devices you own, for as long as these terms are kept. The app itself, its name, its look and its effects belong to FLSH. You may not copy, resell, reverse-engineer or redistribute it.

WHAT YOU MAKE IS YOURS

Every photograph and video you make with FLSH belongs to you, entirely and without condition. We claim no licence over it, no right to use it, and no right to see it. We could not exercise one if we wanted to: what you shoot stays on your phone unless you export and share it yourself, and FLSH has no server of ours for it to reach us through. An export made without a clean print carries a small FLSH mark; that is a mark on your photograph, not a claim on it.

You are responsible for what you photograph, and for having the right to photograph and share it.

FREE AND PRO

FLSH is free to shoot with. Frames and clips are saved inside the app at no cost. A photograph can go to your photo library straight away carrying the FLSH mark, at up to 2048 pixels on its long edge, with nothing to watch and nothing to pay. Or you can watch a short advertisement, which earns five clean prints: those leave with no mark and at full size, they do not expire, and one is spent for each photograph that saves. A clip carries the mark that was written into it while it recorded.

FLSH Pro unlocks every chapter and every kind of light in the app, and exports every photograph clean and at full size, with no advertisement and no mark. The mark on a clip is written as the clip records, so clips filmed before you bought Pro keep it.

Subscriptions

All purchases are processed by Apple, and Apple's terms govern them. Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We cannot issue refunds ourselves, though we would rather hear from you than have you leave unhappy.

WHAT THE APP DOES NOT DO

FLSH changes light, colour, contrast, grain and glow. It does not alter faces. No reshaping, no smoothing, no generative AI, and it is not a beauty filter. This is a design commitment, and we would rather it be written here than only in marketing.

YOUR PHOTOGRAPHS ARE YOUR RESPONSIBILITY TO KEEP

Frames stay inside FLSH until you export them. That means deleting the app, losing the phone, or restoring it without a backup will take them with it. If a photograph matters, export it to your photo library. We have no copy and no way to recover one.

ACCEPTABLE USE

Do not use FLSH to photograph people who have not agreed to it where they would expect privacy, to harass anyone, or for anything unlawful. Do not attempt to defeat the purchase mechanism or the export flow.

IF YOU CAUSE THE PROBLEM

If somebody brings a claim against us because of what you photographed, published or did with FLSH, you will cover what that costs us, including reasonable legal fees. This is not us shifting our own mistakes onto you: it covers claims that arise from your use of the app, not from the app itself.

ENDING IT

You can stop using FLSH whenever you like; deleting the app ends this agreement, though a subscription you bought is cancelled through Apple and not through us. We can end your right to use FLSH if you break these terms, in particular the section above on acceptable use. The sections on ownership, warranties, liability and this paragraph survive the end of the agreement, because they are the ones that matter afterwards.

NO WARRANTY

FLSH is provided as it is. We work to make it reliable and we will fix what breaks, but we do not promise it will be uninterrupted or error-free, or that it will run on every device and every version of iOS.

LIMITS

To the extent the law allows, FLSH is not liable for indirect or consequential loss, including lost photographs or lost profit. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim. Nothing here removes rights you have as a consumer that cannot be removed by agreement, which in the European Union is a good deal.

Apple requires these to be said plainly by anybody who writes their own terms rather than using Apple's, and they are true:

IF PART OF THIS FAILS

If a court decides any part of these terms cannot stand, the rest still stands and the part that failed is read as narrowly as it must be to work. These terms, together with the privacy policy, are the whole agreement between us about FLSH, and they replace anything said before.

CHANGES AND CONTACT

These terms may change; the date at the top will say when, and this page is linked from Settings inside the app, so what you open there is always the current version. They are governed by the laws of Spain, and disputes belong to the courts there, without prejudice to any right you have to bring a claim where you live.
